Description

NASA/ARC has a requirement to extend the performance period of the Operationally Responsive Space (ORS) Office for an additional 6 months. This extension will provide on-going ORS services in conjunction with the ORS office in Albuquerque, New Mexico pending completion of the procurement process. A modification reflecting this extension will be issued on or before November 30, 2009, which is the expiration date of the current contract. This work under the ORS contract includes a reference design for a Multi-Mission Space Vehicle (MMSV), including the instrument (sensor), and definition of the payload, bus, and launch vehicle interfaces. NASA/ARC intends to award an additional requirement for contract NNA08BC42C as a result the period of performance will be extended. This effort was awarded as a firm fixed price contract to Micro Sat Systems Inc. on September 23, 2008. This award was the result of full and open competition. The current contract, inclusive of a 5.5 month Base Period and a 4 month Option Period. The extension of the contract shall result in a 15.5 month period of performance including the basic requirement and all options.

NASA is citing as authority for this Other Than Full and Open Competition provided by 10 U.S.C. 2304(c)(1). The ORS contract requires design for a Multi-Mission Space Vehicle (MMSV), including the instrument (sensor), and definition of the payload, bus, and launch vehicle interfaces. Only one responsible source. No alternate source could adequately provide this support during this brief extension period without extended dealy and duplication of costs.

It is the intent of the government to award this action on a sole source basis. Award to another source would result in substantial duplication of costs and unacceptable delays in fulfilling the Government’s requirements.

The proposed contract action is for services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302.1. The purpose of this action is to extend the period of performance requirement. A Market Survey was not performed for this requirement since it was solicited on a competitive basis. The current Option Period does not provide sufficient time or funds to complete this requirement; as a result the ORS office has requested additional work to fully emphasize the need to make the Multi-Mission Space Vehicle (MMSV) compatible with meeting the needs of RF missions, including radar, Communications and Tactical EW, which is associated with the current SOW.

This notice of intent is not a request for competitive proposals. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government.

Notwithstanding this stated intent, interested parties may submit their capabilities and qualifications to perform the effort IN WRITING to the identified point of contact not later than 4:30 p.m. local time on September 20, 2009. Such communication of capabilities/qualifications will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. Oral communications are not acceptable in response to this notice.

The Government does not intend to acquire a commercial item using FAR Part 12. See Note 26.
