Description

NASA/HQ has a requirement for Prosecution of Trademark Registration Applications for a Base Period of 1 year from December 2011 – November 2012 with (4) One-Year Options via a Single Award Blanket Purchase Agreement (BPA). The Statement of Work is incorporated by reference as “Attachment A” – The specifications are linked above or may be accessed at http://prod.nais.nasa.gov/cgi-bin/eps/bizops.cgi?gr=C&pin= .

This notice is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation, which is issued as a Request for Quotation (RFQ); quotes are being requested and a written solicitation will not be issued. Offerors are required to use the On-Line RFQ system to submit their quote. The On-line RFQ system is linked above or it may be accessed at http://prod.nais.nasa.gov/cgi-bin/eps/bizops.cgi?gr=C&pin= . The information required by FAR Subpart 12.6 is included in the on-line RFQ.

The Government intends to acquire a commercial item using FAR Part 12 and the Simplified Acquisition Procedures set forth in FAR Part 13.

Questions regarding this acquisition must be submitted in writing (e-mail is preferred) no later than November 18, 2011. It is the quoter’s responsibility to monitor this site for the release of amendments (if any). Potential quoters will be responsible for downloading their own copy of this notice, the on-line RFQ and amendments (if any).

Trademark Services

Background

United States and International Registrations for NASA Trademarks

Scope of Work

I) Prosecution of trademark registration applications that have already been filed in the European community regime in order to secure allowance, including:

a. NASA Insignia (also referred to as the “meatball”), and
b. “NASA” ” (as a non-stylized word mark);

I) Assisting, as needed, with the maintenance of existing U.S. trademark registrations that have been secured in the U.S., and maintaining the additional existing trademark registrations secured in foreign countries (through renewals, filing of evidence of use, etc.); and

I) Assisting, as needed, with the filing and prosecution of new U.S. applications to register additional NASA “brands” that agency management deems worthy of protection, and filing and prosecuting new applications to register such NASA “brands” in the European Community to secure European Community Trademark Registrations.

Specific Services to be Performed

I) Filing and prosecuting new trademark applications in the European community and, possibly, in the U.S.;

I) Prosecution directed towards securing the grant of pending trademark registration applications in the European Community Trademark Registrar offices;

I) Correspondence (including telephone discussions) regarding legal issues and legal instructions between the outside law firm and NASA Office of the General Counsel COTR (including consideration of NASA instructions);

I) Upon specific authorization of the NASA Office of the General Counsel, preparation, filing and prosecution of appeals to rejections by Trademark Attorney/Examiner. Preparing, filing, and prosecuting responses to notices of opposition and cancellation (and similar contests and challenges filed by third parties); and

I) Attending to the successful renewal of issued foreign trademark registrations and, possibly, issued U.S. registrations (including filing statements of affidavits evidencing use, where required).

Fees and Costs

I) Anticipated types of acceptable fees and costs associated with this Statement of Work that would be allowable include, but are not limited to:

a. Official governmental filing, prosecution, appeal, renewal, etc. fees;
b. Professional services fees for preparation, filing, and prosecution of each application and maintaining the active status of each issued registration;
c. Professional services fees for appeals from rejections by Trademark Attorney/Examiner;
d. Fees for claiming priority;
e. Fees for preparation and filing of drawings and specimens;
f. Fees for renewal of issued registrations (including evidence of use statements);
g. Fees for responding to notices of opposition (and similar contests and challenges filed by third parties): and
h. Other fees, charges, taxes, and all other disbursements NASA would be expected to make.
