Description

NASA/MSFC intends to negotiate on a sole source basis with The Boeing Company Phantom Works Southern California for a long duration orbital vehicle (LDOV) technology demonstrator under the Advanced Technology Flight Demonstration Vehicle (X-37) Project. The X-37 project is for unique specialized equipment to test and demonstrate advanced technologies in support of NASA’s Space Launch Initiative (SLI). Boeing is currently on contract for LDOV design and development work, which has progressed to a point whereby the Agency requires replacement of the short duration orbital vehicle effort currently on contract with a long duration orbital vehicle. Currently, the Government and Boeing have invested approximately $150 million dollars toward the orbital vehicle design and development effort, which would not be recovered through re-competition. NASA/MSFC intends to purchase the LDOV from Boeing as the only known source which can meet Agency requirements pursuant to FAR 6.302-1(a)(2)(iii) for follow-on Agency requirements. Boeing?s and the cumulative Governmental funding of the X-37 design and development, along with the follow-on nature of this procurement action, fulfills the exception to competition regarding duplicative costs to the Government pursuant to FAR 6.302-1(a)(2)(ii)(A). It should be noted that this action does not include the acquisition of launch services for the X-37 project. The Government does not intend to acquire a commercial item using FAR Part 12. Interested organizations may submit their capabilities and qualifications to perform the effort in writing to the identified point of contact not later than 4:30 p.m. local time on July 24, 2003. Such capabilities/qualifications will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to compete this proposed effort on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the government. Oral communications are not acceptable in response to this notice. All responsible sources may submit an offer which shall be considered by the agency. An Ombudsman has been appointed.
