Description

NASA/KSC intends to procure engineering design, development, and testing services for cryogenic self-contained breathing apparatus and cryogenic zero loss storage/supply/fill system for use in mines on a sole source basis from BCS Life Support, LLC (BCS) under the authority of FAR 6.302-1 – Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of highly specialized equipment. BCS has a history (Space Act Agreements KCA-4129, KCA-4328) of working with KSC to develop new and innovative technologies in the cryogenic life support field specifically targeting needs relevant to KSC.

BCS has independently developed technologies to store liquid air indefinitely without loss (Zero-loss liquid air storage systems). This technology is a key component in the plans to store liquid air in mines for use in emergency escape scenarios. BCS has existence of limited rights in data for both the zero loss storage technology and the Attitude Independent Pickup (AIP), and is solely responsible for the concepts, owner of the intellectual property, and the holder of patent applications

The Government does not intend to acquire a commercial item using FAR Part 12.

Interested organizations may submit their capabilities and qualifications to perform the effort in writing to the identified point of contact not later than 4:30 p.m. local time on August 4, 2012. Such capabilities/qualifications will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to compete this proposed effort on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the government.

This notice is not a request for competitive proposals; however, any firms believing they can fulfill the requirement of this system may provide a written response, which may be considered by the agency. It must clearly show the ability to be responsive without compromising the quality, accuracy or reliability of the services provided and without causing programmatic hardship.

Oral communications are not acceptable in response to this notice.

FAR 52.232-18 Availability of Funds. Funds are not presently available for this contract. The Government’s obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer.
