Description
Langley Research Center has a requirement to increase the maximum value of the existing cost-plus-fixed-fee, Indefinite Delivery/Indefinite Quantity (IDIQ) contract with the National Institute of Aerospace, Inc. (NIAA) for leading edge research in emerging fields, for education in science and engineering, and for dissemination (including promotion and outreach) of the results of the research and technology developed by NIAA. The maximum IDIQ value will increase from $36M to $64M. The increase will permit NASA to continue to obtain these services from the NIAA within the original scope and the original period of performance of the existing contract. The current 5-year contract expires March 11, 2013.
Unforeseen changes to the Center’s mission and unexpected budget increases resulted in the shortfall in estimating the maximum value of the current contract. The statutory authority for award of the existing contract was 10 U.S.C. 2304 (c)(3) which provides that full and open competition need not be provided for when it is necessary to award the contract to a particular source or sources in order to “establish or maintain an essential engineering, research, or development capability to be provided by an educational or other nonprofit institution or a federally funded research and development center.” NIAA is the only responsible source for increased services that are within the technical scope of the current contract and within its original performance period. Therefore, the authority at 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, Only One Responsible Source, also applies to this requirement to increase the maximum value of the existing IDIQ contract with no change in its original scope or period of performance. The NIAA is also the only source that can provide LaRC access to the NIAA’s unique educational and research services.
The Government does not intend to acquire a commercial item using FAR Part 12. See Note 26.
Interested organizations may submit their capabilities and qualifications to perform the effort in writing to the identified point of contact not later than 4:30 p.m. local time on March 12, 2010. Such capabilities/qualifications will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to compete this proposed effort on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the government. Oral communications are not acceptable in response to this notice.
